1. Acceptance of Terms

By accessing or using DGR ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms constitute a legally binding agreement between you and DGR Inc.

2. Description of Service

DGR provides file protection infrastructure that applies progressive degradation to unauthorized copies while preserving originals for authenticated owners. The Service includes:

• File upload, encryption, and storage
• Format-specific degradation algorithms
• Access control and authentication
• REST API and SDK for integration
• Usage analytics and access logs

3. Acceptable Use

You may use the Service only for lawful purposes. You agree NOT to:

• Upload files containing malware, viruses, or malicious code
• Violate intellectual property rights of others
• Upload illegal content (CSAM, terrorist content, etc.)
• Attempt to bypass security measures or access other users' files
• Use the Service to harass, abuse, or harm others
• Reverse engineer or decompile the Service
• Resell or sublicense the Service without authorization
• Generate excessive API load or abuse rate limits

4. Your Content and Responsibilities

You retain all rights to files you upload. By uploading, you grant DGR a limited license to:

• Store, encrypt, and transmit your files
• Apply protection and degradation as configured
• Process files to provide the Service
• Make backups for reliability and disaster recovery

You are solely responsible for the legality, reliability, and appropriateness of your uploaded content. You represent that you have all necessary rights to upload and protect your files.

5. Subscriptions and Billing

• Free Tier: Limited features, no payment required
• Paid Plans: Billed monthly via Stripe
• Auto-Renewal: Subscriptions renew automatically until canceled
• Changes: Plan changes take effect immediately with proration
• Cancellation: Cancel anytime; access continues through current billing period
• Refunds: No refunds for partial months or unused features
• Price Changes: We may change pricing with 30 days notice

6. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We may suspend service for maintenance, upgrades, or to protect system integrity. We are not liable for temporary unavailability.

7. Termination

We may terminate or suspend your account for:

• Violation of these Terms
• Non-payment of fees
• Illegal activity or abuse
• At our discretion with 30 days notice

Upon termination, you have 30 days to download your files before permanent deletion.

8. Warranties and Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES INCLUDING:

• Merchantability, fitness for a particular purpose
• Non-infringement, accuracy, reliability
• Uninterrupted or error-free operation
• Complete prevention of unauthorized access

DGR provides protection tools but cannot guarantee absolute security. You are responsible for choosing appropriate protection settings.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DGR IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

10. Indemnification

You agree to indemnify and hold harmless DGR from any claims, damages, or expenses arising from: (a) your use of the Service, (b) your content, (c) your violation of these Terms, or (d) your violation of any third-party rights.

11. Changes to Terms

We may modify these Terms at any time. Material changes will be notified via the Service dashboard. Continued use after changes constitutes acceptance. If you disagree, discontinue use and close your account.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of North Carolina. Any disputes shall be resolved through binding arbitration in North Carolina, except that either party may seek injunctive relief in court.

YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND CLASS ACTION PARTICIPATION.
